TERMS AND CONDITIONS OF SALE

PREAMBLE

The present general conditions of sale apply to all products offered by LIZE CREATIONS on its website www.zede-paris.com.

They aim to provide a framework for all transactions (deadlines, prices, guarantees) on the website, protecting both the customer and the company through a transparent legal basis.

These terms and conditions are agreed between :

The company LIZE CREATIONS, SARL with a capital of 7622,45 euros whose head office is located at 81, rue du Temple 75003 Paris, registered at the Registre du Commerce et des Sociétés de Paris under the number B 414.115.717 (97 B 14159), hereafter called "The seller, LIZE CREATIONS or ZEDE" on the one hand and any non-professional physical person wishing to make a purchase on the website of LIZE CREATIONS www.zede-paris.com, hereafter called "the customer, the consumer or the buyer", on the other hand.

Article 1: PURPOSE

The purpose of these general terms and conditions of sale is to define the mutual rights and obligations of the parties, as well as the various stages of the order process, exclusively for the purposes of the relationship they establish on the Internet. The customer acknowledges having read them at the time of validating the order, and expressly declares his unreserved acceptance of them.

The Customer is clearly informed and acknowledges that the Site is intended for end consumers. Professionals must contact the LIZE CREATIONS sales department in order to benefit from distinct contractual conditions.

The seller reserves the right to modify the general terms and conditions of sale of the www.zede-paris.com website at any time. The application of the new conditions will then be effective on the date of the customer's order.

Article 2: PRODUCT CHARACTERISTICS

The items shown on the site are available for sale while stocks last.

LIZE CREATIONS makes every effort to present the descriptions available on the Site as accurately as possible. However, the photographs and texts are presented for information purposes only and have no contractual value. Unless otherwise indicated on the Site, all Products sold by LIZE CREATIONS are new and conform to current European legislation and standards applicable in France.

Article 3: PRICES

The prices of the articles are inclusive of VAT in Euro. They include any discounts and VAT at the rate applicable on the day of the order. Prices shown on the Site do not include delivery charges, which will be specified and added to the total amount of the order.

LIZE CREATIONS reserves the right to modify its sales prices at any time. Orders placed will then be invoiced at the rates in effect at the time of the order.

Article 4: ORDER CONDITIONS

Article 4.1: Ordering

To order one or more items, follow these steps:

• Click on the item of your choice to access the product page for the selected item.

• Click on "Add to basket", a window will appear.

• Then validate the item by clicking on "Checkout", or continue shopping by clicking on "Continue Shopping". In the latter case, you can validate several items by clicking on the "Basket" logo in the top right-hand corner of the page, then click on "Checkout" to make your payment.

• Once the item has been validated, check the accuracy of the order information (product, color, quantity, price) on the summary sheet and click on "Proceed to payment" to adjust the amount.

• You must then "create an account" or enter the information in the "Quick Order" form. This is to register your billing and delivery information.

• Check that the information is correct, then press "Pay order".

• You are then invited to choose the delivery method that suits you best.

• Read the terms and conditions of sale and tick "I accept the terms and conditions of sale and adhere to them without reservation" and click on "Pay the order" to complete the purchase.

• Pay the order, then confirm.

• Once the purchase has been made, the Customer will receive a confirmation e-mail summarizing the order.

Any finalized order implies that the customer definitively and irrevocably accepts his purchase and the present general conditions of sale.

After validation, the order is sent to LIZE CREATIONS for processing. The customer can only modify or cancel the order by contacting Customer Service by telephone or e-mail, before the parcel is dispatched.

In case of product unavailability, the customer will be informed as soon as possible. In the event that an unavailable product has been cashed, LIZE CREATIONS undertakes to exchange the product for another available product of the same amount, to offer a credit note or to reimburse the customer for the product concerned within 15 days.

The customer may deactivate his account at any time by sending an e-mail to [email protected].

Article 4.2: Order restrictions

The sale of ZEDE products on the www.zede-paris.com site is intended only for buyers whose delivery address is in metropolitan France and abroad (if your country does not appear at the time of delivery, we do not offer delivery). 

Article 5: PAYMENT TERMS

Article 5.1: Method of payment

All orders are payable in Euro. To pay for the order, the customer may choose between the following methods of payment:

• Credit card (Visa, MasterCard, Maestro)

• Paypal account.

• Payment in 3 instalments or in 30 days, Mollie, Bank transfer

LIZE CREATIONS reserves the right to cancel any order in case of payment error, existing dispute with the Customer, total or partial non-payment of a previous order by the Customer, refusal of authorization of payment by credit card, or for any other legitimate reason. LIZE CREATIONS will not be held responsible in this regard.

Article 5.2: Transaction security

To ensure payment security, the www.zede-paris.fr website uses the secure Shopify Payments service. Confidential data (16-digit credit card number, expiry date and cryptogram) are transmitted encrypted directly to the bank's server, without passing through the physical media of the LIZE CREATIONS server.

When the order is validated, the payment request is routed in real time to the Shopify Payments secure payment manager. The latter sends an authorization request to the credit card network. The electronic payment manager issues an electronic certificate.

Article 5.3: Reservation of ownership

The articles remain the property of LIZE CREATIONS until the complete payment of the price.

Article 6: DELIVERY

Article 6.1: Shipping and delivery times

Items are delivered within 1 to 7 working days from the day following validation of the order by the customer throughout metropolitan France. This period includes preparation of the article on receipt of the order, as well as transport time. It is given as an indication and may vary according to the availability of the articles. Exceeding this deadline cannot be held against LIZE CREATIONS, nor give rise to termination of the contract or any compensation for damages.

In case of transport problems, postal services or in case of force majeure, LIZE CREATIONS declines any responsibility on the delivery time.

Items are delivered to the address provided by the customer on the order form. The risks of transport are borne by the customer from the moment the goods are handed over to the carrier. In case of delivery to a collective address, LIZE CREATIONS has no obligation as soon as the goods arrive at the address indicated, even if it is received by a third party.

In case of absence of the customer at the delivery address indicated in the order form, or in case of an erroneous address due to an omission or a typing error, LIZE CREATIONS reserves the right to invoice the delivery service according to the different delivery methods proposed below in Article 6.2.

Article 6.2: Delivery method

When placing the order, the Customer is asked to choose the mode of transport he wishes among the service providers selected by LIZE CREATIONS. The service providers proposed are :

• Post: 48 to 72 hours in working days, upon dispatch
• Point Relais: 3 to 6 working days from dispatch
• UPS

These modes are currently available for France and Europe

Delivery is free for all orders over 80 euros (only Points Relais are free).

Article 7: RIGHT OF WITHDRAWAL

All products sold benefit from the "satisfied or reimbursed" clause. In accordance with the provisions of article L.121-21 of the French Consumer Code, the Customer has a right of withdrawal of 14 days to return the products without having to give any reason. The withdrawal period runs from the day of receipt of the parcel by the Customer or by the third party designated by the Customer.

The cost of the return shipment is borne by the customer.

LIZE CREATIONS reserves the right to request the delivery note as proof.

To exercise his right of withdrawal, the Customer must return the withdrawal form within 14 days using the following form:

The Customer must return the article(s) within 14 days from the day LIZE CREATIONS has been informed of his decision to retract.

If the retraction is requested by the Customer, LIZE CREATIONS will proceed with an exchange, a credit note or the total reimbursement of the price of the item(s) within 14 days following the day the seller becomes aware of the Customer's retraction. In any case, this reimbursement cannot be made before the recovery by LIZE CREATIONS of the object(s) of the Customer's retraction or the proof of the return of the latter.

In case of a refund request, the payment method will be the same as the one chosen at the time of the order unless the customer agrees with LIZE CREATIONS in a different way.

Refunds will only be accepted on condition that the item(s) concerned have not been depreciated as a result of handling other than that necessary to establish their nature, characteristics and/or conformity.

Article 8: GUARANTEE

Article 8.1. Legal guarantee of conformity and guarantee of hidden defects

Products sold on the Site are subject to the conditions of the legal guarantee of conformity (article L 211-4 et seq. of the French Consumer Code) and the guarantee against hidden defects (articles 1641 and 1648 of the French Civil Code). Any warranty is excluded in the event of natural wear and tear of the product, defects and deterioration of external origin or due to abnormal use, improper use, negligence or lack of maintenance on the part of the Customer.

• Article L211-4 of the French Consumer Code

The seller is required to deliver goods in conformity with the contract and is liable for any lack of conformity existing at the time of delivery (...).

• Article L211-5 of the French Consumer Code

To be in conformity with the contract, the property must:

1. Be fit for the purpose ordinarily expected of similar goods and, where applicable :

• correspond to the description given by the seller and possess the qualities that the seller presented to the buyer in the form of a sample or model;

• have the qualities that a purchaser may legitimately expect, having regard to the public statements made by the seller, the producer or his representative, particularly in advertising or labelling;

2. Or have the characteristics defined by mutual agreement between the parties or be suitable for any special use sought by the buyer, brought to the attention of the seller and accepted by the latter.

Article L211-7 of the French Consumer Code

Defects of conformity that appear within six months of delivery of the good are presumed to have existed at the time of delivery, unless proven otherwise. The seller may rebut this presumption if it is not compatible with the nature of the good or the alleged defect of conformity.

Article L211-9 of the French Consumer Code

The seller is obliged to bring the goods into conformity with the buyer's choice requested, proposed or agreed in accordance with article L.211-9.

Article L211.10 Consumer Code

If repair and replacement are impossible, the buyer can return the goods and have the price refunded, or keep the goods and have part of the price refunded.

The same faculty is offered to him:

1° If the solution requested, proposed or agreed in application of article L.211-9 cannot be implemented within one month of the buyer's complaint;

2° Or if this solution cannot be found without major inconvenience for the customer, given the nature of the good and the use he is seeking.

However, the sale may not be rescinded if the lack of conformity is minor.

Article L211-12 Consumer Code

Any action arising from a lack of conformity must be brought within two years of delivery of the goods.

Article L211-13 Consumer Code

The provisions of this section do not deprive the purchaser of the right to bring an action resulting from latent defects as provided for in articles 1641 to 1649 of the French Civil Code, or any other action of a contractual or extra-contractual nature recognized by law.

Article 1641 of the French Civil Code: The seller is liable for any hidden defects in the item sold which render it unfit for its intended use, or which impair this use to such an extent that the buyer would not have purchased it, or would have paid a lower price for it, had he been aware of them.

Article 1648 paragraph 1 of the French Civil Code: The action resulting from latent defects must be brought by the buyer within two years of the discovery of the defect. In the case provided for in Article 1642-1, the action must be brought, on pain of foreclosure, within one year of the date on which the seller can be discharged of any apparent defects.

Article 8.2 Return and refund of defective or non-conforming products

Any return or refund requested by the Customer involving legal guarantees of conformity or hidden defects must remain in the form of explanatory letters and be sent to LIZE CREATIONS by mail, with acknowledgement of receipt, at the following address: 81 rue du Temple, 75003 PARIS.

After verification of the defect or non-conformity of the returned item, LIZE CREATIONS will proceed with an exchange or reimbursement to the Customer of the totality of the price of the items concerned, the return costs, and including the shipping costs if the return concerns the totality of the order.

Article 8.3. Manufacturer's warranty

LIZE CREATIONS undertakes to guarantee the items sold for a period of 2 years from the date of purchase indicated on the invoice. The manufacturer's warranty is intended to cover even defects due to the Customer's own use. This warranty will allow the Customer to benefit from a more complete protection against possible defects and/or damages than the legal warranty.

The warranty takes the form of a free repair service for 2 years after purchase. Shipping costs are at the Customer's expense.

The defects concerned are accessory defects (buckles, snaps and studs).

Discoloration of fabrics is not covered by the manufacturer's warranty, as excessive exposure of fabric items to sunlight is naturally prone to fading, which is irreversible. Improperly caused damage (tears, burns, holes and cuts, stained or scratched fabric or leather) is also excluded from the manufacturer's warranty.

Article 9: INTELLECTUAL PROPERTY

All elements of the www.zede-paris.com site , visual and sound, are the exclusive property of LIZE CREATIONS and are protected by copyright. Consequently, any copy, publication, distribution, broadcasting and use not previously authorized by LIZE CREATIONS is strictly forbidden, and constitutes an infringement punishable by law.

In all cases, any link to our site, even tacitly authorized, must be removed upon simple request from LIZE CREATIONS.

Article 10: DATA PROTECTION (RGPD)

For the smooth running of the order, the personal data collected relating to the consumer will be subject to computer processing.

As such, information concerning him/her may be communicated to LIZE CREATIONS' commercial partners. We strive to comply with the RGPD.

The purchaser may object to the disclosure of his contact details by contacting the customer service department. In accordance with the law of January 6, 1978, the buyer also has the right to access and rectify information concerning him/her. This data processing has been declared to the CNIL.

Article 11: SELLER'S LIABILITY

LIZE CREATIONS has only an obligation of means in the online sales process. It cannot be held responsible for any damage resulting from the use of the Internet, including loss of data, external intrusion, the presence of computer viruses, a break in service or other involuntary problems.

Article 12: APPLICABLE LAW AND VALIDITY OF THESE GENERAL TERMS AND CONDITIONS OF SALE

These General Terms and Conditions of Sale are governed by French law. In the event of a dispute, the French courts shall have jurisdiction, even if the purchaser accesses the www.zede-paris.com website from a country other than France.
