Manufacturer's warranty

LIZE CREATIONS undertakes to guarantee the items sold for a period of 2 years from the date of purchase indicated on the invoice. The manufacturer's guarantee is intended to cover even defects due to the Customer's use. This warranty will allow the Customer to enjoy a more complete protection against possible defects and/or damages compared to the legal warranty.

The warranty is in the form of a free repair service for 2 years after purchase. Shipping costs are at the Customer's expense.

The defects concerned are those of the accessories (buckles, press studs and nails).

Fading of the fabric is not part of the manufacturer's warranty because excessive exposure of fabric items to the sun is naturally subject to fading which is irreversible. Abusive damage (tears, burns, holes and cuts, stained or scuffed fabric or leather) is also excluded from the manufacturer's warranty.

 

 

Legal guarantee of conformity and guarantee of hidden defects
The products sold on the Site are subject to the conditions of legal guarantee of conformity (article L 211-4 and following of the Consumer Code) and the guarantee of hidden defects (articles 1641 and 1648 of the Civil Code). Any guarantee is excluded in case of natural wear and tear of the product, defects and deteriorations of external origin or due to misuse, non-conforming use, negligence or lack of maintenance by the Customer.

 
- Article L211-4 of the Code of Consumption
The seller is required to deliver a good in conformity with the contract and is responsible for defects in conformity existing at the time of delivery (...).


- Article L211-5 of the Consumer Code
To be in conformity with the contract, the goods must:
1º Be fit for the use usually expected of similar goods and, where appropriate :

- correspond to the description given by the seller and possess the qualities that the seller has presented to the buyer in the form of a sample or model;

- have the qualities that a buyer may legitimately expect in view of public statements made by the seller, the producer or his representative, particularly in advertising or labelling;

2º Or have the characteristics defined by mutual agreement between the parties or be suitable for any special use sought by the buyer, brought to the knowledge of the seller and accepted by the latter.


Article L211.7 Code de la consommation
Defects of conformity which appear within six months from the delivery of the good are presumed to exist at the time of delivery, unless proven otherwise.
The seller can fight this presumption if it is not compatible with the nature of the good or the claimed defect of conformity.


Article L211-9 Code la consommation
In case of lack of conformity, the buyer chooses between repairing or replacing the good. However, the seller may not proceed according to the buyer's choice if this choice entails a cost that is clearly disproportionate to the other method, given the value of the goods or the importance of the defect. He is then obliged to proceed, unless this is impossible, according to the method not chosen
by the buyer.


Article L211.10 Code de la consommation
If the repair and replacement of the good are impossible, the buyer can return the good and have the price returned or keep the good and have part of the price returned.

The same option is offered to the buyer:
1° If the solution requested, proposed or agreed upon in application of article L.211-9 cannot be implemented within one month following the buyer's complaint;
2° Or if this solution cannot be implemented without major inconvenience for the buyer, given the nature of the goods and the use he is seeking.
The resolution of the sale may not be pronounced if the lack of conformity is minor.


Article L211-12 Code de la consommation
The action resulting from the defect of conformity is prescribed by two years as from the delivery of the good.


Article L211-13 Code de la Consommation
The provisions of the present section do not deprive the buyer of the right to exercise the action resulting from the redhibitory defects such as it results from articles 1641 to 1649 of the civil code or any other action of contractual or extra-contractual nature which is recognized to him by the law.


Article 1641 of the Civil Code: The seller is bound by the guarantee on account of hidden defects of the thing sold which render it unfit for the use for which it is intended, or which so diminish this use that the buyer would not have acquired it, or would only have paid a lower price for it, if he had known about them.


Article 1648 paragraph 1 of the Civil Code: The action resulting from redhibitory defects must be brought by the purchaser within two years from the discovery of the defect. In the case provided for by Article 1642-1, the action must be brought, under penalty of foreclosure, within one year following the date on which the seller can be discharged of the apparent defects.


Return and refund of defective or non-conforming products

Any return or refund requested by the Customer involving the legal guarantees of conformity or hidden defects must remain in the form of explanatory letters and be sent to LIZE CREATIONS by post, with acknowledgement of receipt, at the following address: 81 rue du Temple, 75003 PARIS.

After verification of the defect or non-conformity of the returned item, LIZE CREATIONS will exchange or reimburse the Customer for the totality of the price of the item(s) concerned, the return costs, and including the shipping costs if the return concerns the entire order.
